TERMS AND CONDITIONS

IMPORTANT

These are the important terms and conditions that apply, so please read carefully BEFORE you make a booking to stay with us.

About Us
Our/Us/We means Devonia Escapes LLP trading as Devonia Escapes.  Our registered office is at Haycroft, Buckland Brewer, Bideford, Devon, EX39 5NA.  We are a Limited Liability Partnership established in England and Wales.  Partnership No. OC439245.

Making A Booking
You must be 21 years of age or over to book accommodation and stay with us.
A maximum of two adults per cabin.
In case of unforeseen circumstances, we strongly recommended that you are protected by your own appropriate travel insurance prior to making your booking.

Payment Methods
We accept payment by Credit or Debit card as well as Bank Transfer. 
We do not accept cash or cheques.

Booking Confirmation
All bookings via our online booking system must be treated as provisional until you receive our booking confirmation via email. 
A booking confirmation via email will be sent after we receive the deposit or payment in full (see Terms and conditions below).
If a booking is made 6 weeks or more prior to your arrival date, a 30% non-refundable deposit payment is required. The balance, if applicable, is payable 6 weeks prior to your arrival date.  If the balance is not paid by the due date, we reserve the right to re-let the accommodation and retain the deposit.
If a booking is made less than 6 weeks prior to your arrival date, payment is required in full including any additional charges must be paid at the time of booking.
All emails will be sent to the address provided by you in the booking form.  When you receive an email from us, please check all details carefully and contact us immediately if you find any discrepancies.
Prices on our website are not binding.  We reserve the right to modify these prices at any time.
Prices stated on the booking confirmation email / invoice are binding.
We may list our accommodation with external third parties.  We are not responsible for any pricing of third parties. 
We reserve the right to accept or reject bookings entirely at our discretion and without a statement of reason.

Cancellation
We strongly recommend that you are protected by your own appropriate travel insurance to cover any cancellation costs you may incur.
In the event you need to cancel your booking, the following Terms and conditions apply:

  • Bookings cancelled 6 weeks or more prior to arrival date will receive a refund of monies paid less your deposit;
  • Bookings cancelled between 4 to 6 weeks prior to arrival date forfeit 50% of the full booking price;
  • Bookings cancelled with less than 4 weeks prior to arrival date receive no refund.
  • During your stay any bookings cut short with us for any reason receive no refund.

If we manage to re-let your cancelled dates, we will be happy to refund you the full amount minus a £30 administration fee.
If you are unable to travel due to personal illness (e.g. Coronavirus or any other sickness) our cancellation Terms and conditions above will apply.
We must be notified in writing should you need to cancel your booking.
We reserve the right to cancel bookings at any time if you are found to be disruptive, rude, obstructive, abusive and/or break these Terms and conditions.  In such circumstances, you will be required to vacate the accommodation immediately and no refund will be payable to you for the unexpired part of your stay.

Booking Amendments
Any requests to rearrange your booking will be at our discretion.
We regret that any request to amend booking dates within 4 weeks of your arrival date will not be permitted unless the property has been re-let, in which case 75% of any monies paid will be refunded. 
If you are no longer able to stay this will be classed as a cancellation as detailed above.

Check In and Check Out Times
Your accommodation will be ready for check in by 3pm and we ask that you arrive by 8pm on the day of arrival.
Please notify us in advance what time you expect to arrive on the day of check in. 
On the day of departure, you must check out promptly by 10am, unless you are checking out on a Sunday, in which case you do not need to leave until Midday.  
Late departure will result in an additional charge being made.

Accommodation Care
You agree to keep your accommodation clean and tidy and on your departure, leave it in such condition as you found it on arrival.  
Any damages or breakages must be reported to us as soon as you can and prior to your departure.
Accommodation left in an excessively dirty or inappropriate state may be subject to an additional cleaning surcharge.
We reserve the right to enter the accommodation, at a reasonable time, in the event of an emergency or remedial work being required.

Damages Deposit
At the time of booking, a damages deposit of £100 is payable.
We maintain a comprehensive inventory of all contents of each accommodation, both practical and decorative.  You will be required to pay for any damage to such items and will be charged for any item that is removed or lost.
The damages deposit will be refunded in full to the card used at the time of booking within 5 days of the departure date provided there is no damage or item removed or lost following your stay.  Please note that the refund is subject to the card provider’s processing times.
We cannot accept responsibility or liability for any loss or damage to personal possessions, vehicles or personal accidents whilst on our site.

Dogs
A maximum of two well-behaved and house-trained dogs are permitted to stay at Kingfisher Cabin only on our site.  A flat fee of £25 must be paid in advance to cover additional cleaning costs.
Do not leave your dog(s) unattended on site at any time.
We ask that you and your dog(s) respect all property on our site, especially inside the cabin.  Please do not allow your dog(s) onto the bed or sofa.
Do not let your dog(s) off the lead, unless in the cabin and enclosed decking area – we are a working farm, there is a public footpath and animals in the surrounding fields.
Please make sure you clean up after your dog, we provide a conveniently located dog poo bin.
You will be required to pay for any damage to items as a result of naughty or unwell dog(s).
We cannot be held responsible for any accident or injury to your dog(s) during your stay.

Smoking / Vaping
Smoking/vaping is not permitted inside your accommodation or outside on the wooden decked area.
Smoking/vaping is permitted outside of the accommodation off decked areas whilst on site but guests must extinguish all cigarette ends fully and dispose of them and other smokers’ materials responsibly into a bin. 
Cigarette ends and matches must not be left on the ground under any circumstances.  Care must be taken when smoking and disposing of cigarette ends and matches, especially in the warmer months as foliage can be flammable.
If it is evident that you have been smoking/vaping within the accommodation, we reserve the right to charge for any fumigation required.

Candles
The use of candles and tea lights (beyond any battery-operated ones we provide) are not permitted in your accommodation or anywhere on the site.

Wood burner, Fire Pit/Stove, Barbecues & Other Open Fires / Naked Flames
To use the wood burner or fire pit/stove you are required to set and manage a controlled fire.  
You must read the instructions provided in advance of using the wood burner or fire pit/stove and use all facilities responsibly.
We provide one bag of seasoned logs and kindling for use with the wood burner or fire pit/stove.  Please contact us to purchase additional supplies if required.
You must never leave a naked flame unattended. 
The fire pit/stove must remain on the specifically dedicated paving slab on the decking area.
You are not permitted to make or light an open fire, camp fire or barbecue anywhere on the site.

Visitors
Day guests are welcome to visit. 
Please notify us of their arrival in advance.  We will require their contact details should we, in case of an emergency, need to know who is on site.
All visitors must leave the site by 10pm and we ask that you please consider the wildlife, neighbouring properties and other guests staying on the site and keep the noise level to a minimum.

Utilities
Should there be a failure in a utility or service (such as water, heating, electricity, sewerage) please notify us immediately and we will aim to restore the utility or service as quickly as possible.
Should any failure of utility or service provided by us extend beyond a 12-hour period from notification, recompense will be proportionate to the loss of enjoyment suffered, unless the reason for the failure in a utility or service is beyond our control.

Safety
We provide accommodation adjacent to a genuine working farm in a countryside environment.  This environment presents inherent risks and these form part of the experience when you stay.
You may use the farm lane to access the farmyard and honesty shop but you are not permitted to access the remaining parts of the farm or surrounding fields due to dangers such as electric stock fencing and large farm vehicles etc.
Various animals inhabit the surrounding farmland such as chickens, cows, sheep and horses.  We request that you do not enter fields with animals in, except when following a public footpath, and we request that you do not feed the animals.
You are responsible for your own safety.  You are reminded of the higher degree of risk this environment presents and you should always take appropriate and reasonable care for your safety and the safety of others.  This includes wearing suitable clothing and footwear for the terrain and weather conditions.  
Whilst we will endeavour to keep the steps and decking areas clean, please be aware that when wet, these can become very slippery.  You must take care at all times.

Environmental Considerations
We are situated in the countryside close to farmland, waterways and woodland and accommodation has been carefully and considerately designed to provide maximum comfort whilst respecting the surrounding wild environment.
Please be mindful of neighbouring properties nearby.  We ask that you keep noise levels to a minimum (including the use of music) when on site and likewise when you are entering and leaving your accommodation.
We have provided recycling bins for your waste and ask that you separate waste into these bins accordingly.

Personal Property
We cannot accept responsibility or liability for any loss or damage to personal possessions, vehicles or personal accidents whilst on our site.
Vehicles, accessories and contents are left at the owner’s risk.  It is recommended that your holiday insurance covers loss or damage to personal effects.

Items Left Behind
If we find the item left behind and it can be posted, we will endeavour to arrange its return to you, subject to the postage and packing costs.  If an item left behind cannot be posted, then we will keep the item for 14 days to enable you to arrange collection.
We do not accept any responsibility for returning items of lost property.

Access & Parking
We are situated just off a narrow unclassified road.  Please drive slowly and carefully on this road and be considerate of neighbouring properties on your arrival and departure from the site.  Be mindful that pedestrians, cyclists, horse riders and farm animals use the road as well as private and commercial vehicles.
Free on-site private parking is provided with access to our EV Charging facility (ask us for the access PIN).
A short winding path of bark shavings leads you on an undulating walk from the parking-area to your cabin.
Please leave the gateway clear and gate closed because access is required at all times for farm vehicles and walkers using the public footpath. 
Vehicles and contents are left at your own risk.

Availability
Each booking is made in good faith with the belief that your accommodation will be available to you on the date stated.  If for any reason due to circumstances out of our control, your accommodation is not available, we will refund your deposit and balance payment in full.  You will have no further claim against us for compensation or consequential losses.

Adverse Travel Conditions & Inclement Weather
We hold no responsibility if you are unable to attend due to extreme weather or traffic conditions (i.e., snow, flooding, wind, road congestion etc.).  If you are unable to reach us due to poor weather conditions or travel issues, you will lose your full payment and an alternative break will not be offered.  Please ensure you have full travel insurance to cover such an instance.

Restrictions On Rental
We reserve the right to remove any person or persons from the accommodation due to unreasonable behaviour, or any behaviour that adversely impairs the enjoyment of other guests (including excessive noise), damage to the property or exceeding the stated occupancy.  In such circumstances, you will be required to vacate your accommodation immediately and no refund will be payable for the unexpired part of your stay.
It is a condition of booking that accommodation may only be occupied by the person named in the booking and/or their companion.  The accommodation may not be sub-let to a third party.  If this is found to be the case, the third party will have no legal right of occupancy and will be required to vacate the accommodation immediately.

Extraordinary Circumstances Affecting Your Stay
We accept no liability for ‘force majeure’ events prior to or during your stay totally beyond our control e.g. destruction of property due to flood, fire, earthquakes or acts of nature; or if the property becomes uninhabitable due to irreparable damage or health and safety issues, that could not reasonably have been foreseen.  In such cases refunds will be at our discretion.

Complaints
We endeavour to make sure your stay with us is memorable for all the right reasons.  However, we do recognise that from time-to-time things can go wrong.  In these circumstances it is your responsibility to make any such problems known to us immediately it becomes apparent, thereby giving us the opportunity to correct the situation.  Unless this procedure is followed, no subsequent claim will be considered.
We will make every endeavour to rectify any identified problems as soon as is reasonably possible.
